Texas PTO law overview
Texas does not require vacation payout by statute but the Texas Payday Law enforces written employer policies. Texas employers who promise vacation payout in written policies must follow through.
Texas's Payday Law treats written promises of vacation payout as wage commitments. Texas workers with written employer vacation payout policies can file wage claims with the Texas Workforce Commission if those promises are not honored.
Governing law
Texas PTO and vacation law is governed by Texas Payday Law Texas Labor Code 61.001 (Tex. Lab. Code § 61.001). The official authority for Texas wage and hour enforcement including PTO disputes is the Texas Workforce Commission.
