Florida minimum wage overview
Florida's minimum wage is constitutionally mandated and adjusts annually each September 30 based on inflation. Florida voters approved Amendment 2 in 2020 establishing a path to $15 per hour by 2026 with annual increases thereafter.
Florida is unique in having its minimum wage enshrined in the state constitution via Amendment 2, making it much harder to reduce. The constitutional amendment also establishes the inflation indexing mechanism. Florida's minimum wage increases take effect September 30 each year rather than January 1.

Florida minimum wage is governed by Florida Constitution Article X Section 24 (Fla. Const. Art. X, § 24). This statute establishes the minimum hourly wage that Florida employers must pay covered employees.

What if my employer pays less than minimum wage?
If your employer is paying you less than the Florida minimum wage of $13.00 per hour, you have the right to file a wage claim with the Florida Department of Economic Opportunity. You may be entitled to recover back wages plus penalties. Most states allow you to recover unpaid wages going back 2-3 years. You can also file a complaint with the federal U.S. Department of Labor Wage and Hour Division which enforces the federal minimum wage under the FLSA.
