Oregon family and medical leave - key facts
Federal FMLA protections plus Oregon-specific paid leave information
Oregon leave law overview
Oregon Paid Leave provides up to 12 weeks of paid leave for family, medical, or safe leave reasons, with up to 14 weeks for pregnancy-related conditions. Oregon's program provides up to 100% wage replacement for the lowest-wage workers.
Oregon's program has one of the most progressive benefit structures nationally - workers earning up to 65% of the state average weekly wage receive 100% wage replacement. Higher earners receive 60% of wages above that threshold.
Federal FMLA in Oregon
All Oregon workers at employers with 50 or more employees within 75 miles are also covered by the federal Family and Medical Leave Act (29 U.S.C. 2601). Federal FMLA provides up to 12 weeks of unpaid, job-protected leave per year for a qualifying serious health condition, to care for a family member, or to bond with a new child. You must have worked for your employer for at least 12 months and at least 1,250 hours in the past year to be eligible.
Governing law
Oregon leave law is governed by Oregon Revised Statutes ORS 657B.010 (ORS § 657B.010). The official authority for Oregon family and medical leave is the Oregon Employment Department.
