New Hampshire family and medical leave - key facts
Federal FMLA protections plus New Hampshire-specific paid leave information
New Hampshire leave law overview
New Hampshire has a voluntary paid family leave program providing up to 6 weeks of benefits at 60% wage replacement. The program is funded through voluntary employee premiums and is available to all New Hampshire workers who opt in.
New Hampshire's program is unique in being voluntary rather than mandatory. Employees opt in and pay premiums for coverage. New Hampshire state employees are automatically enrolled. The voluntary nature means not all New Hampshire workers have coverage.
Federal FMLA in New Hampshire
All New Hampshire workers at employers with 50 or more employees within 75 miles are also covered by the federal Family and Medical Leave Act (29 U.S.C. 2601). Federal FMLA provides up to 12 weeks of unpaid, job-protected leave per year for a qualifying serious health condition, to care for a family member, or to bond with a new child. You must have worked for your employer for at least 12 months and at least 1,250 hours in the past year to be eligible.
Governing law
