Nevada family and medical leave - key facts
Federal FMLA protections plus Nevada-specific paid leave information
Nevada leave law overview
Nevada has its own family and medical leave law that covers employers with 50 or more employees, mirroring the federal FMLA. Nevada does not have a state paid family leave program.
Nevada's state FMLA mirrors the federal law in coverage and protections. Nevada workers should look for proposed paid leave legislation that has been discussed in recent legislative sessions.
Federal FMLA in Nevada
All Nevada workers at employers with 50 or more employees within 75 miles are also covered by the federal Family and Medical Leave Act (29 U.S.C. 2601). Federal FMLA provides up to 12 weeks of unpaid, job-protected leave per year for a qualifying serious health condition, to care for a family member, or to bond with a new child. You must have worked for your employer for at least 12 months and at least 1,250 hours in the past year to be eligible.
Governing law
Nevada leave law is governed by Nevada Revised Statutes NRS 613.335 (NRS § 613.335). The official authority for Nevada family and medical leave is the Nevada Office of the Labor Commissioner.
