Delaware leave law overview
Delaware's paid family and medical leave program began in 2025. The program provides up to 12 weeks of paid leave for parental bonding, serious health conditions, or military qualifying events.
Delaware's paid leave program covers employers with 10 or more employees for parental leave and 25 or more employees for medical and family care leave. Delaware workers at smaller employers may only have federal FMLA protections.
Federal FMLA in Delaware
All Delaware workers at employers with 50 or more employees within 75 miles are also covered by the federal Family and Medical Leave Act (29 U.S.C. 2601). Federal FMLA provides up to 12 weeks of unpaid, job-protected leave per year for a qualifying serious health condition, to care for a family member, or to bond with a new child. You must have worked for your employer for at least 12 months and at least 1,250 hours in the past year to be eligible.
