Colorado leave law overview
Colorado FAMLI provides up to 12 weeks of paid leave for family or medical reasons, with an additional 4 weeks for pregnancy-related conditions. Benefits are based on a percentage of wages with higher replacement rates for lower-wage workers.
Colorado FAMLI launched in 2024 and covers most Colorado workers regardless of employer size after a waiting period. The program uses a sliding scale replacement rate - lower-wage workers receive up to 90% of their wages while higher earners receive a lower percentage.
Federal FMLA in Colorado
All Colorado workers at employers with 50 or more employees within 75 miles are also covered by the federal Family and Medical Leave Act (29 U.S.C. 2601). Federal FMLA provides up to 12 weeks of unpaid, job-protected leave per year for a qualifying serious health condition, to care for a family member, or to bond with a new child. You must have worked for your employer for at least 12 months and at least 1,250 hours in the past year to be eligible.
